On Friday, June 21, the US Supreme Court upheld a federal law that prohibits individuals under domestic-violence restraining orders from possessing firearms.
Chief Justice John Roberts, writing for an 8-1 majority, affirmed that this law does not violate the Second Amendment.
The ruling came in response to a case involving Zacky Rahimi, who faced allegations of domestic violence and subsequent possession of firearms despite a restraining order against him.
The Court’s decision clarified that such restrictions are constitutionally permissible when there is evidence of a credible threat to the safety of an intimate partner.
This overturns a previous 2023 ruling by the 5th US Circuit Court of Appeals, which had questioned the law’s alignment with constitutional principles established in prior firearm regulation cases.
